Cutting Or Removal Of Trees On Leases

INTRODUCTION

All trees are a part of the real property owned by the University of the South. University ordinances provide that trees may not be cut, bull-dozed or otherwise removed or destroyed by a leaseholder without approval of the University Forester. The following guidelines will cover most situations.

REMOVAL OF TREES

Any leaseholder desiring to remove one or more trees (including the clearing of an area for construction of a home) shall first contact the University Forester. If his approval is given, the University Forester will also advise the leaseholder whether the University wishes to retain the wood in the tree(s) to be removed. If the University does wish to retain the wood, the tree(s) will be removed by the University at its expense. If the University waives any claim to the wood, all costs of removing the tree(s) shall be at the expense of the lessee.

DEAD AND DANGEROUS TREES

On existing leases removal of dead trees, trees that have become dangerous, or major limbs that are broken or dangerous, is the responsibility of the lessee. However, the procedure for approval, and for determining ownership of the wood and allocation of cost, shall be the same as for other trees.

EXCEPTIONS

A residential leaseholder need not apply for permission to remove, at his or her own expense, any tree which is less than 4.5 feet in height. Trees which are greater than 4.5 feet in height and less than (6) inches in diameter at the ground line may be removed at the leaseholders own expense without permission from the University Forester if it is one of the following species (linked to helpful identification information):

The University Forester will make identification of trees for this exception when necessary.

SECURING PERMISSION TO CUT TREES

All tree cutting or trimming of trees must be approved in advance by the University Forester or his representative and shall be conducted in such manner and at such time as to be convenient for the University to exercise its option to convert and remove any parts of the cut trees.

All costs of the cutting (and clean-up) of such trees shall be borne by the leaseholder. Clean-up standards shall be set by the University Forester and agreed to by the leaseholder before cutting commences. If the University wants to use the wood, then the University shall bear the costs of removing materials from the site.

REQUEST FOR NEW LEASE SITE AND APPROVAL OF BUILDING PLANS

The first step in this process is to schedule a preliminary site visit with Domain Manager (x1268) to discuss house plan ideas and the lot you have selected. If a lot and plan are incompatible, it may be recommended that one or the other be changed.
